Terms and conditions

Signing up to our services implies your agreement to the below terms.

The Client agrees to enter into a contract with PrivateRelay. PrivateRelay provides services to its Client in the form of data transfer and storage. PrivateRelay shall make every good faith to ensure that its servers are available with as little service interruption as possible.

The parties acknowledge that the Internet is neither owned nor controlled by any particular entity; therefore it is understood that, where out of direct control of PrivateRelay, PrivateRelay cannot be held responsible for the inability of Client or any third party to connect to its servers.

System usage

Services provided by PrivateRelay may not be used:

  • For the sending of unsolicited email (SPAM)
  • For the transmission of intellectual property not owned by the Client

Service provision is provided under 'Fair use'. PrivateRelay reserves the right to limit service where it deems that the Client has exceed this policy of fair use.

Except with PrivateRelay's express permission, Clients may not sell, lease or lend PrivateRelay services to other third parties, be it for either commercial, non-commercial or any other gain.

The Client agrees to use the PrivateRelay services only for their personal use. Client will not enter into any actions to access PrivateRelay services other than those to access their own private data using the agreed protocols. Client will not engage in any attempt to gain unauthorised access, or to hack PrivateRelay servers.

Client agrees to keep their contact information up to date to facilitate contact by PrivateRelay for administrative reasons on the use of their account, or notification of service modifications.

Trial accounts (where available)

The following terms apply for our trial accounts:

  • Accounts are provided for a period of one month.
  • Disk space allowed for the account is 200Mb.
  • Email aliases are not available for trial accounts.
  • Domain aliases (additional domain extensions eg. .eu, .net etc) are not available for trial accounts.
  • Suspension will occur on the expiry date of the account. Should you not renew the account with one of our standard packages within 30 days, the account will be scheduled for deletion.
  • Should you decide to sign-up for our services, you may then choose to add domain alias accounts.
  • Only one trial account per Client.
  • In the unlikely event that we detect abuse of an account, we reserve the right to withdraw service on that account without prior notice.

Data encryption

PrivateRelay provides access to and from Client's devices using encrypted data connections. Where data is sent or received externally to / from third party services, PrivateRelay will also attempt to use encrypted connections on these links, where the external system has support for that encryption.

Limited Liability

Under no circumstances, including negligence, shall PrivateRelay be liable for any direct, indirect, incidental, special or consequential damages that result from the use, or inability to use, the PrivateRelay service, or that result from mistakes, omissions, hacking, interruptions, deletion of files or email, errors, defects, bugs, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorised access to PrivateRelay records, programs or services.

Notwithstanding the above, PrivateRelay specifically denies any responsibilities for any damages arising as a consequence of non-accessibility of its servers. Client's exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the aggregate amount which Client paid during the term of this contract.

PrivateRelay will make every effort to keep Client data secure on their internal own networks. Client understands that data sent externally may not be relayed in encrypted format where the external system may not support it.

Lawful Purpose

Client may only use PrivateRelay's services for lawful purpose.

Account inactivity / deletion

Accounts which remain unpaid at their renewal date will be suspended, but remain on our servers for ninety days. If the account has not been renewed after that time the account will be deleted.

Security

Clients must make every effort to ensure that their access to PrivateRelay's services remains secure. In the event of any security breach, Clients should attempt to change their password / security questions. Lockout of Client accounts should be notified, as soon as possible, to our technicians.

Modification

We are constantly improving our services. We therefore hold the right to add or remove functionality or features. If a specific service is withdrawn we will give our Clients, where reasonably possible, advanced notice and a chance to export data from that service.

Termination

Client may terminate this agreement by the request to delete their account. PrivateRelay will inform the Client after the account has been deleted. Some data may remain in our backups, but will in turn be deleted as per our Privacy Policy.

PrivateRelay may terminate services covered by these Terms and Conditions at any time, without penalty, if the Client fails to comply with the terms included herein.

Personal data

Conforming to the articles 39 and those following, of the French law number 78-17 dated the 6th of January 1978 and modified in 2004 relating to computing, files and freedom, all users can obtain details, and request modifications or deletions, of information which concerns them by writing to PrivateRelay, 18 place de la Chapelle, 75018 Paris, France.

Jurisdiction

This Agreement shall be governed and construed in accordance with the laws of France.
